Kemp, Ruge & Green Law Group understands all of Florida’s car insurance laws in Trinity, FL.  As it affects a great number of our personal injury clients, we always must be aware of any changes in the car insurance laws Trinity, FL.

The 1970s

Mandatory no-fault car insurance was enacted into law in the 1970s. Before no-fault was enacted, people in Florida were frustrated because it took so long to get their money to cover their expenses after a car accident.  So, lawmakers thought that the process could be sped up if no one was to blame for the accident. Tampa Car Accident Attorney hoped no-fault insurance would make rates go down. Unfortunately, car insurance rates went up in no-fault states.

Personal Injury Protection

As no-fault insurance has been in effect for over 50 years now, the problems are quite obvious now.  The Tampa Car Accident Attorney Protection part of the law is the worst part.  Drivers don’t have to be responsible for bad driving because each driver’s insurance pays expenses.

It also brings out a lot of fraud claims.  Phony medical care providers file fraudulent claims and collect Personal Injury Protection payments.

No one is happy with the no-fault laws, yet it is mandatory for every Florida driver to carry the no-fault car insurance and Tampa Car Accident Attorney.  Since no-fault car insurance makes Florida car insurance so expensive, 20% of the drivers in Florida drive without any insurance at all.

Today

As a result, the state Legislature has been trying to repeal the no-fault laws for years. Legislators want to replace it with a fault-based system like they have in other states and have mandatory bodily Tampa Car Accident Attorney coverage.

Finally, in 2021 the Florida legislature voted to repeal the no-fault laws and wanted to replace them with a regular at-fault car insurance policy that would have a mandatory $25,000 limit for one person’s bodily injury and $50,000 for two people.

However, Gov. DeSantis vetoed the bill making no-fault Tampa Car Accident Attorney still the law of the land.
