The ruling allows thousands of Canterbury homeowners to bring class action lawsuits against state insurer Southern Response.
The decision is the final chapter in litigation as to whether the class action is “opt-in” or “opt-out”.
While Southern Response advocated an opt-in approach, the class action lawyers felt that an opt-out approach should be used – one that would involve all policyholders.
Class action agent Grant Cameron says the decision will be of tremendous importance to future class actions.
He says it will ensure that New Zealanders get adequate access to the justice they deserve.
