The Supreme Court will hear arguments on Tuesday in one of the biggest blockbusters of the tenure: California v Texas, the constitutional challenge to the Affordable Care Act. A group of Republican-ruled states say the law’s individual insurance mandate is unconstitutional – and they are asking the court to knock down all of the law along with the mandate. Lydia Wheeler, a senior legal reporter for Bloomberg Law, sits down with SCOTUStalk host Amy Howe to preview the case and discuss how the three newcomers to the bench – Judges Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett – Address the constitutionality of the mandate and the legal doctrine known as separability.
