Atlas Biologicals Inc.’s motion for attorneys’ fees and expert witness fees, following a final judgment for Atlas in its copyright and trademark action under federal and state law against a former employee, was granted in part and denied in part by the federal district court in Colorado. The court granted the motion as to Atlas’s request for attorneys’ fees because Atlas has met its burden of persuading the court that the hours expended and the hourly rates are reasonable and that this is an exceptional case warranting an upward lodestar adjustment of 16 percent.
