According to the lawsuit filed, the San Gorgonio Memorial Hospital allegedly (a) did not pay minimum wages, (b) did not pay overtime wages, (c) did not provide legally required meal and rest hours, (d) failed to provide accurate pay slips, (e) failed to do so reimbursed employees for necessary business expenses; and (f) failed to provide wages when due, all in violation of the applicable sections of the Labor Code set out in Sections 201, 202, 203, 226 of the Labor Code . 226.7, 510, 512, 1194, 1197, 1197.1, 2802 and the applicable wage ordinance (s) and leads to civil penalties due to this alleged behavior.
The defendant allegedly asked plaintiffs and members of the California class to do off-clock work. This reportedly included standing in line and the mandatory temperature check for COVID-19 screening before check-in. Allegedly, plaintiffs were not paid for the overtime they accrued for performing the required temperature tests. The state and federal law provides that employees must receive overtime at one and a half times their “regular pay”.
