“However, bans and bans are not an effective strategy to address these concerns as the consequence of bans on adult choice of tobacco products is a potential illegal market,” the company said.

Mitch Kokai, senior policy analyst at the John Locke Foundation libertarian think tank, said attorneys general could be “virtue signs of a relatively unpopular habit”.

The FDA took action in February 2020 to remove some flavored electronic cigarette products, but allowed tobacco and menthol flavorings to remain in the market.
Also in February 2020, the U.S. House of Representatives passed a bill by 213-195 votes that would drastically tighten federal tobacco regulations, including banning all non-tobacco flavors in tobacco products.
The democratically sponsored HR 2339 entitled “Reversing the Youth Tobacco Epidemic Act” was not taken up by the US Senate.
