Scott Peterson again in court docket as lawyer seeks new trial

Scott Peterson, convicted of the murder of his wife Laci and their unborn son Connor, virtually appeared in court on Friday to repeat his death sentence.

Peterson appeared through a computer screen from the San Quentin State Prison.

The nation’s first investigations and legal proceedings followed after Laci Peterson disappeared from her Modesto home on Christmas Eve 2002.

Peterson was eventually found guilty and sentenced to death, but questions have since arisen about both the first trial and his conviction.

The California Supreme Court overturned the death sentence this summer after finding that the original trial judge had not properly screened potential jurors for their position on the death penalty and whether or not they could remain neutral.

“Well, he’s excited that he’s going to have a chance,” said Peterson’s attorney Pat Harris. “He’s been there for 15 years, 15 for a very long time. And he’s happy to have the opportunity to finally go back to court. “

Peterson waived a speedy trial and it now looks like it will be a few months before his case is brought to justice.

Before his verdict can be tried again, however, a question about one of the jurors in his case must first be resolved. The court also found that a juror lied about her previous experience of being a victim of a crime, and a San Mateo County judge must now determine whether that lie was serious enough to constitute a judicial misconduct. In this case the whole case can be tried again.

“In his retrial, or in his retrial, you will hear many things that were not brought up in the first trial. A lot of new evidence has been exposed, ”said Harris.

“Scott is innocent and someone else committed this crime,” said Peterson’s sister-in-law, Janey Peterson.

The jury misconduct issue is back on trial in Redwood City Monday.
