We are pleased to publish a recent magazine article by our Chinese IP expert Paolo Beconcini, which was published in the Review of Intellectual Property Law (RIPL). In this article, Dr. Beconcini provided a thorough and well-documented overview of recent changes to China’s trade secret protection and enforcement regulations. Many of these changes were made in response to the 2018 U.S. WTO lawsuit and the U.S.-China trade wars, including shifting the burden of proof and lowering law enforcement thresholds. The article evaluates the implementation of promised changes and offers suggestions for further changes, as well as guidance for practitioners in addressing the trade secret enforcement challenges in China.
